I James Attree of the parish of Cuckfield in the county of Sussex
Yeoman being of sound Mind Memory and understanding do hereby revoke all Wills Codicils and Testamentary dispositions whatsoever made by me at any time heretofore and declare this to be my last Will and Testament I desire to be decently interred at the discretion of My executors hereinafter named I direct all the just debts which I shall owe at the time of my decease my funeral expences and the expences of proving this my Will to be paid with all convenient speed after my death Whereas I sometime since contracted and agreed with Thomas Packham of Cuckfield aforesaid Yeoman and Charles Jenner of the same place Butcher Devisses In Trust under the will of Francis Brigden* deceased for the absolute purchase of all that Freehold Messuage or Tenement Barn Stable Orchard and Lands with the Appurtenances thereunto belonging containing by estimation thirty Acres more or less commonly called or known by the names of Lockstrood and Dumbrells fields or by whatsoever other name or names the same or any part thereof are or is called or known situate lying and being in the parish of Wivelsfield in the said County of Sussex late in the tenure or occupation of Richard Whiting or his Assigns And also all that piece or parcel of ground containing by estimation thirty four Rods be the same more or less lying and being in the parish of Wivelsfield aforesaid and Ditcheling in the said County of Sussex one or both of them heretofore part of the Old Road and purchased by one William Brigden deceased of and from the trustees for repairing the Road from New Chappel to the Top of Ditcheling Bost Hills and which said Messuage Lands and Hereditaments by Indentures of Lease and Release bearing date respectively the twenty seventh and twenty eighth days of September now las past were granted and conveyed to me my Heirs and Assigns for ever Now I the said James Attree Do give end devise unto my Friends Thomas Kennard of Cuckfield aforesaid Yeoman and Charles Heasman of Ardingly in the same County Yeoman All that the aforesaid Messuage or Tenement Barn Stable Lands Hereditaments and premises hereinbefore mentioned and described with their and every of their appurtenances To hold unto the said Thomas Kennard and Charles Heasman their Heirs and Assigns for ever in Trust that they the said Thomas Kennard and Charles Heasman or the survivor of them and his Heirs do and shall with all convenient speed after my decease absolutely sell dispose of and convey the said Freehold Messuage Buildings Lands Hereditaments and premises with their Appurtenances and the Inheritance thereof in fee 1 James Attree simple either together or in parcels by Public Sale or Private contract as they in their or his discretion shall feel fit unto any person or persons who may be willing to become the Purchaser or Purchasers thereof or of any part thereof for the most money that can be reasonably obtained for the same and do and shall or that purpose make and execute all such Deeds Conveyances and Assurances as they the said Thomas Kennard and Charles Heasman or the survivor of them and his Heirs shall think fit and be advised necessary for the completion of such sale or sales and the Money arising from such sale after payment thereout of all Costs Charges and Expences attending the same and all incidental Expences relating thereto In Trust to pay and equally divide the same unto and amongst my Sons and Daughters, James Attree, William Attree, Mary the wife of Thomas Mitchell of Cuckfield aforesaid labourer, Sarah the wife of Edward Constable of Lindfield in the said County of Sussex Bricklayer and my Son Thomas Attree and their legal Representatives share and share alike and which I do hereby give and bequeath to them accordingly Provided always and I do hereby direct and appoint that all and every person and persons to whom the said Thomas Kennard and Charles Heasman and the survivor of them and his Heirs shall by virtue of this my Will make Sale of Convey and Assure the said freehold Messuage Buildings Lands Hereditaments and premises hereby directed to be sold or any par or parts thereof and his her and their Heirs upon payment of his her or their Purchase Money unto the said Thomas Kennard Charles Heasman or the survivor of them and his Heirs and having his or their receipts or receipt for the same shall be effectually discharge therefrom and shall not be liable to see to the Application thereof or be answerable or accountable for any loss misapplication or nonapplication of such Purchase money or any part thereof I give and bequeath all my personal Estate and Effects after payments of my debts funeral and Testamentary expences to be equally divided between my aforesaid Sons and Daughters and their legal Personal Representatives share and share alike And I do hereby nominate constitute and appoint the said Thomas Kennard and Charles Heasman Joint Executors In Trust of this my Will In Witness whereof I the said James Attree the Testator have to this my last Will and Testament contained in three sheets of Paper set my hand at the 2 James Attree bottom of the first and second sheets and my Hand and Seal to this third and last sheet the fourteenth day of January in the fifty second year of the Reign of our Sovereign Lord George the Third by the Grace of God of the United Kingdom of Great Britain and Ireland King Defender of the Faith and in the Year of our Lord One thousand eight hundred and twelve ./- James Attree Signed Sealed Published and declared by the said James Attree the Testator as and for his last Will and Testament in the presence of us who in his presence at his request and in the presence of each other have hereunto subscribed our names as witnesses Saml Waller Saml Waller Junr John Picknell The 11th day of March 1823 There were sworn Thomas Kennard and Charles Heasman the joint Executors in this Will named To whom was committed the burthen of the Execution thereof Sworn also that the Goods Chattels and Credits of the Deceased do not amount in Value unto three hundred pounds By us George Proctor Surrogate Will of James Attree late of Cuckfield but at the time of his death of Wivelsfield decd *bur
